Terms of Service

By using Nodown ("the Service"), you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

Access to and use of Nodown is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Nodown provides uptime monitoring, alerting, and status page services. We check your websites, APIs, and infrastructure endpoints at regular intervals and notify you when they become unavailable or degrade in performance.

3. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access at [email protected].

4. Acceptable Use

You may only monitor endpoints you own or have explicit permission to monitor. You may not use Nodown to:

Monitor third-party services without authorization
Conduct denial-of-service testing
Circumvent rate limits or access controls on third-party systems
Engage in any illegal activity

Violation of these rules may result in immediate account termination.

5. Service Availability

We aim for high availability but do not guarantee 100% uptime of the Nodown platform itself. Planned maintenance windows are announced in advance. We are not liable for damages resulting from service interruptions.

6. Payment and Refunds

Paid plans are billed monthly or annually in advance. Upgrades take effect immediately. Downgrades take effect at the next billing cycle. We do not offer refunds for partial billing periods, but we will work with you to resolve billing issues on a case-by-case basis.

7. Data and Privacy

We handle your data in accordance with our Privacy Policy. By using Nodown, you consent to our data practices as described in that policy.

8. Termination

You may cancel your account at any time from the account settings page. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be retained for 30 days and then deleted.

9. Limitation of Liability

Nodown is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of the Service.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Continued use of the Service after changes constitutes acceptance of the new Terms.
